Terms and Conditions
One led by the guest and accepted by hotel room reservation established between both parties a contract , called the hotel accommodation contract .
1 These Terms and Conditions govern contracts for the rental use of hotel rooms for lodging and all other services provided to the customer provided by the hotel .
2 The lower and further letting of the rooms, as well as their use for purposes other than accommodation require the prior written consent of the hotel .
3 The customer's terms and conditions apply only if expressly agreed in writing beforehand .
4 For the reservation of meeting rooms and related services of the hotel our Terms and Conditions are effective . Detailed information , please request this ( conference folder ) .
II. Conclusion of Contract , Parties , Liability , Statute of Limitations
The contract is concluded by acceptance of the application by the customer by the hotel . The hotel confirmed the room reservation in writing .
1 Contractual partners are the hotel and the customer . Has placed the order a third party , he is liable to the hotel together with the customer and severally liable for all obligations arising from the hotel accommodation contract , if the hotel has a corresponding statement by the third party.
2 The hotel is liable to the diligence of a prudent businessman for his obligations under the contract . Customer's claims for damages are excluded . Does not include damages from injury to life, body or health, or if the hotel is responsible for the breach of duty and other damages based on an intentional or grossly negligent breach of obligation . A breach of obligation by a legal representative or vicarious agent. Should disruptions or defects in the performance of the hotel occur, the hotel will endeavor to obtain knowledge or to a breach of the customer to remedy the situation . The customer is obligated to make reasonable to eliminate the disruption and to keep any possible damage
3 The hotel is liable to the customer in accordance with the legal provisions of the things brought . However, the hotel is only liable up to an amount equal to one hundred times the room rate for one day, but at least up to the amount of € 600.00 and a maximum of up to the amount of € 3,500.00 , for cash, securities and valuables takes the instead of € 3,500.00 , the amount of € 800.00 .
4 If the customer has a parking space in the hotel garage or a hotel parking lot , even if a fee is provided , this does not constitute a safekeeping agreement . For loss of or damage to the hotel property parked or motor vehicles and their contents , the hotel is not liable , except for willful misconduct or gross negligence. This also applies to agents of the hotel . It applies to the entire site , the Highway Code .
5 The limitation period for all claims of customers a year, unless the hotel is not liable for gross negligence or willful misconduct or , mandatory mandatory statutory limitation provisions .
6 This limitation of liability and brief limitation period apply to the hotel even in breach of covenants in the contract negotiations .
III . Services, prices, payment, settlement
1 The hotel is obligated to keep the rooms reserved by the customer available and to render the agreed services.
2 The customer is obliged to pay the applicable or agreed for the rooms provided and for other services used by him in hotel prices . This also applies caused by customer services and outlays to third parties.
3 The agreed prices include the applicable VAT.
4 The prices can be changed by the hotel if the customer later wishes to make changes to the number of reserved rooms, the hotel or the length of stay and the hotel agrees.
5 Hotel invoices not showing a due date within 10 days from receipt of the invoice without deduction . The hotel reserves the right to make accumulating accounts receivable payable at any time and to require immediate payment. If payment is delayed, the hotel is entitled to charge interest at the rate of 5% above the base rate . The customer has the evidence of lower of the hotel a higher damage. Cash, bank transfer and payment by debit and Maestro cards will be charged. Payments with Visa and Mastercard will be a service charge of 2 %, calculated at American Express of 3.5%.
IV. Repudiation by Customer (Cancellation , Annulment)
1 The customer will be given to terminate the contract in accordance with the following cancellation conditions the right . If the cancellation until 29 days before arrival , no cancellation fee will be charged . If cancellation is made 28 days before arrival , if not be resold to 80 % cancellation fee if booking with breakfast and 70% charged when booking half board, except for the last minute booking in the area, free of charge is not possible here. Instead of these packages , the customer is entitled to prove that the damage is either not at all or that it is at a lower level .
Please note that this paragraph comes into force in case of early departure.
V. Room Availability , Delivery and Return
1 The customer has no right to be provided specific rooms.
2 Unless otherwise agreed, the hotel room is not possible reference clock before 15h00 the day of arrival .
3 The return of the hotel room must be made on departure until 11.00 clock . If the return time is exceeded, the hotel will charge the customer 50 % of the list price ( list price ) . The customer is free to prove that the hotel incurred no or much lesser claim is a charge for use .
4 For registration of several groups of people , travel , seminar and conference events the hotel 14 days prior to arrival or prior to the event are notified the list of participants . Political events are to be clearly identified in the application .
1 Pets are allowed only with the prior consent of the hotel and with additional charge . In public places such as restaurants, bar , pool area , etc. Pets are not allowed .
2 The liability for damages other than personal injury is limited to intent and gross negligence.
VII. Final Provisions
1 The amendments or additions to the contract , the acceptance of these Terms and Conditions for Hotel Accommodation If writing. Unilateral amendments and supplements by the customer are not valid .
2 Performance and payment is the location of the hotel .
3 Exclusive jurisdiction , also for check and exchange disputes - commercial transactions is the seat of the hotel . If a contracting party fulfills the requirements of § 38 paragraph 1 ZPO has met and has no general jurisdiction in Germany , the courts at the seat of the hotel .
4 German law applies .
5 Should individual provisions of these General Terms and Conditions be invalid or void ¬ for Hotel Accommodation be or , as the validity of the remaining provisions shall not be affected . In place of the ineffective clause shall automatically an appropriate statutory scheme . Moreover, the statutory provisions apply.
